Ardeley 49 is only recorded as a footpath, but has been riden for many years. The BHS has made an application for the route to be recorded at higher status based on the user evidence collected. Part of Ardeley 49 was already the subject of a modification order application based on historical evidence submitted by the East Herts Footpath Society.

Legal History 30 Jul 2003: EHFS application for part of Ardeley 49 to be recorded as a byway, with the route south to road past Cromer Windmill. HCC reference EH/287. 28 Jun 2022: Application for Ardeley 49 to be recorded as part restricted byway and part byway open to all traffic. HCC reference EH/287.
